Global FRAND Licensing in the Digital ERA: Negotiation, Disputes, Remedies and Resolution Across Jurisdictions (CLE Webinar)

On March 9, 2022, firm founder Pat Breslin spoke on a panel as a valuation expert and moderator for an AIPLA* Webinar entitled, “Global FRAND Licensing in the Digital Era: Negotiation, Disputes, Remedies, and Resolutions Across Jurisdictions.” The expert panel focused on patents and related standards for smart phones, smart cars, and the digital economy.

Mr. Breslin joined IP law experts from Europe, Japan, and the UK, adding a US perspective and valuation expertise to an esteemed panel that included Takanori Abe, of Abe & Partners (Japan); Eeva Hakoranta, EVP and Chief Licensing Officer for Interdigital; Dr. Clemens-August Heusch, VP and Head of Global Litigation and Disputes at Nokia; and Jane Mutimear, IP partner at Bird & Bird LLP (UK).

The panel addressed dynamic and sometimes contentious issues concerning “standard essential patents” (SEPs) and SEP owners’ commitments to offer “fair, reasonable, and non-discriminatory” (FRAND) licenses to those making products that use the standard. In addition to his expertise in patent and IP valuation, Mr. Breslin contributed his experience in complex, cross-border technology licensing to the conversation.

Global reputation

Our experts often participate in major international economic policy forums and global reform initiatives. We present papers and analyses in multilateral forums such as the OECD in Paris, before the Committee on Fiscal Affairs and treasury officials and delegates from many countries. Our work on IP and international policy and practice reform efforts address some of the highest priority issues for governments globally, from the G-20 to developing and emerging economies–as well as issues affecting our clients and companies worldwide.

Reliable approach

Analyzing complex transactions – whether in IP, finance, or international tax or trade contexts –  is rarely a straightforward matter. Where economic analysis is required, not all roads lead to the same place. A lot depends on who is navigating. You need an experienced, independent and thoughtful perspective on your issues – backed up with sound economics and finance principles. Our reliable approach and analyses has provided insight in light of the changing global landscape, while avoiding pitfalls that occur with short-sighted solutions that push problems down the wrong road or into other jurisdictions.

Deep experience

Our extensive experience includes valuation, intellectual property (IP) valuation, R&D finance, technology development, and transfer pricing. Our knowledge about key issues involving innovation-based sectors and industries is a major asset in client matters. Example areas of experience include testimony in IP litigation concerning music copyrights and digital distribution platforms, early stage technology development and finance, transfer pricing litigation, IP litigation concerning mobile commerce technology, and international disputes involving oil and gas-related transactions, and the automotive, consumer products and electronics industries.
